When the trial started, Emily called upon several citizens to be character witnesses for Nikolas, hoping that it would ease the way a little. But alas, the judge did not feel pity for Nikolas and sentenced him to time at Statesville. When Emily tried to go see Nikolas at the PCPD before he was sent away, he had Lucky send her away. Elizabeth and Emily went to Kelly's to wait things out. But as they were chatting the phone rang and Emily learned that Nikolas had tried to escape and was shot.

She rushed over to General Hospital to be with her husband. She begged him to hold on and not die. Nikolas was rushed into surgery and Emily waited patiently at the door, willing her husband to live. Once out of surgery, Emily stayed by Nikolas' bedside waiting for him to wake up. When he did awaken, he asked her forgiveness for trying to push her away.

The newlyweds were happy to be spending whatever time they could together and were not happy to see Connor appear at the hospital. He claimed remorse for putting the couple through their current nightmare and offered to help. Connor suggested that he and Nikolas switch places, and that Connor would go to jail for Nikolas. Emily didn't believe he was sincere and sent him away.

A couple of days later, Luke stopped by to inform Emily that Laura was dead. Emily offered her sympathies to Luke and agreed to tell Nikolas about his mother. After Nikolas woke up, she informed him that his mother had died and his insincere reaction tipped Emily off. She demanded Connor tell her where her husband was immediately. Connor informed her that Lucky helped make the switch and whisked his brother off to a remote cabin. Emily stormed out of the room.

When she arrived at the cabin, she found Nikolas passed out in the cold and snow. She got him back in the cabin and started to nurse him back to health. Once Nikolas was awake, the couple discussed going on the run together. Nikolas did not want to subject his wife to a life on the run, never being able to fulfill her dream of becoming a doctor. They were on their way to the police station, when the cops surrounded the cabin. Nikolas was taken back into custody and eventually sent off to Statesville.

Feeling helpless, Emily went to the Haunted Star to talk with Luke. Luke informed Emily that he had a theory that Helena wasn't really dead, but just trying to ruin Nikolas and Emily's chance at happiness. This set Emily off on a new adventure. With the help of Lucky and Elizabeth, she headed for Canada to find Connor and ask him to pretend to be Nikolas. The hope was that if Helena thought Nikolas had gone free, then she would come out of hiding.

After several weeks, Helena came by the Haunted Star to see "Nikolas". As usual, the old lady threatened to hurt Emily and that sparked the foursome to agree that Emily and Connor should go into hiding, until Helena was caught. Elizabeth and Lucky came by the cabin as often as possible, but never with the news that Helena had been caught. Emily couldn't wait to get back to her life and free her husband, however, Connor was becoming more obsessed with making Emily his.

One night, after going out with Lucky and Elizabeth for a bite, Emily returned to find that Connor had tried to recreate a romantic moment between her and Nikolas. She was very upset that he had gone through her things and that he would even think that the two of them had a chance. She stormed off to her room and went to bed. Later that night, she woke and went looking for Connor. There was an eerie feeling in the cabin. Connor made an advance at Emily that she quickly rebuffed. This seemed to set something off in him and he attacked her. She fought him off and raced to the basement to seek refuge. Unfortunately, he found her and brutally raped her. In the end, Emily shot Connor and killed him.

Elizabeth and Lucky arrived at the cabin and instantly figured out what had happened. Elizabeth wanted to get Emily to a hospital right away, but Lucky thought they should keep it quiet, so as not to reveal their plans to Helena. However, Helena had witnessed the killing and thought that Emily had killed her beloved grandson. While Lucky and Elizabeth went to get the car started to head back to town, Helena came in. Emily informed Helena all about the plan and that it was Connor that she killed and not Nikolas. Helena took Emily, telling her that she could verify that information easily.

A search began immediately for Helena and Emily. In the meanwhile, Helena tortured Emily, by telling her that she was going to inform Nikolas that Emily had been unfaithful to him. Emily cowered in the corner until the lady left her in the Casadine crypt alone. After some sneaky thinking, Emily managed to get the guards to come in and snuck one of their cell phones from them. Once they left, she called the PCPD to inform them of her whereabouts. However, the connection was bad and the police headed off to the Quartermaine crypt. Lucky, Elizabeth and Skye figured out that Helena had taken Emily to the Cassadien crypt and Lucky raced off to save her. Once there, a struggle ensued and the gun went off. Lucky was rushed to the hospital and Helena slipped away yet again.

In the months after the rape, Emily became very emotional. She was easily startled, would have nightmares of the rape and distanced herself from Nikolas. She would not admit to anyone what had really happened. When Lucky was released from the hospital, he moved into Wyndmere to try and help Emily through her problems. Alas, he figured out that he was of no help to her at all. Finally, the friends were able to convince Emily that she needed to seek counseling. The hardest thing that Emily had to face was going to visit her husband and tell him that she had been raped. He felt so helpless and wanted to help her but she quickly retreated. When he was finally released, he rushed to be with her, but Emily had gone to the Quartermiane mansion to hide behind her family.

Despite NikE's best intentions their marriage could not survive the rape, and Nikolas began to pull away, attracted to Courtney Matthews Jacks, a woman married to Jasper "Jax" Jacks. Throughout the summer of 2005, Nikolas and Courtney began a relationship, consummating it on the eve of his final breakup with Emily.

As Nikolas and Courtney moved in their own direction, Emily found herself drawn into the instant-made family of Sonny Corinthos and his sons, Michael and Morgan. As fall turned into winter, Sonny and Emily resisted the attraction between until they finally gave in.

At the same time, it was revealed that Courtney was pregnant, the paternity of the child a mystery, was it Nikolas or Jax? Through numerous paternity tests it was revealed that Jax was the father, or was he???
